Introduction

These Terms of Service ("Terms") govern your access to and use of www.therento.com, including any related mobile applications, features, content, and services (collectively, the "Platform"). By accessing, browsing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

We may update these Terms at any time by posting the revised version on the Platform. Your continued use after changes constitutes acceptance of the updated Terms. Review this page regularly for updates.

Definitions

• "You" or "User": Any individual, landlord, tenant, agent, estate agency, or entity accessing or using the Platform.
• "Platform": www.therento.com and all associated websites, apps, tools, and services provided by Rento.
• "Content": Any text, images, listings, data, reports, or materials on or submitted to the Platform.

Acceptance of Terms

By registering, listing a property, submitting an enquiry, requesting/completing screening, or otherwise using the Platform, you accept these Terms and represent that you are at least 18 years old (or have legal capacity to contract) and authorised to provide any information shared. If acting on behalf of an entity, you warrant you have authority to bind it.

Terms of Use

You agree to use the Platform only for lawful purposes and in compliance with these Terms and all applicable laws (including South African legislation such as the Consumer Protection Act, Rental Housing Act, and POPIA).

Prohibited Activities

You must not:

• Transmit, distribute, store, or destroy material in violation of any law or regulation;
• Infringe copyrights, trademarks, trade secrets, privacy, publicity, or other intellectual property/personal rights of others;
• Post or share defamatory, obscene, threatening, abusive, hateful, discriminatory, or otherwise objectionable content;
• Use robots, spiders, scrapers, or automated tools to access, monitor, or copy Platform content without express written permission;
• Interfere with the Platform's operation (e.g., via viruses, overload, denial-of-service, spamming);
• Impose an unreasonable or disproportionately large load on infrastructure;
• Copy, reproduce, modify, distribute, publicly display, or create derivative works from Platform content without prior written consent;
• Reverse-engineer, decompile, disassemble, or attempt to access unauthorised areas;
• Forge headers, impersonate others, or engage in fraudulent activity.

Violations may result in immediate suspension/termination of access, without refund, and potential legal action.

Copyright and Intellectual Property

All Platform content (including software, databases, text, graphics, icons, designs, trademarks, and logos) is owned by Rento or its licensors and protected by South African and international intellectual property laws. No license or rights are granted to you beyond limited, personal, non-commercial use as necessary to access the Platform. You may not use Rento's trademarks without permission.

By submitting content (e.g., property listings, photos, details), you grant Rento a perpetual, royalty-free, worldwide, non-exclusive license to use, reproduce, display, modify (for formatting), and distribute it on the Platform.

Privacy and Cookies

Your use of the Platform is also governed by our Privacy Policy (linked separately), which details data collection, use, sharing, and protection. By using the Platform, you consent to such practices. We use cookies and similar technologies as described in our Cookie Policy.

Security

You must not attempt to breach Platform security, including:

• Unauthorised access to data/accounts;
• Probing, scanning, or testing vulnerabilities without permission;
• Interfering via viruses, spam, overload, or similar means;
• Forging communications or sending unsolicited bulk emails.

Violations may lead to civil/criminal liability. Rento may investigate and cooperate with authorities.

Disclaimer of Warranties and Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind (express or implied), including accuracy, completeness, timeliness, virus-free status, or fitness for purpose.

Rento:

• Does not act as an estate agent, attorney, conveyancer, financial advisor, valuer, or party to any rental/transaction;
• Hosts third-party content (listings, reviews, etc.) but does not verify, endorse, or guarantee it;
• Is not liable for any agreements, decisions, losses, or damages (direct, indirect, consequential, punitive) arising from Platform use, including reliance on content, screening reports, or external links;
• Is not responsible for third-party sites linked from the Platform.

To the fullest extent permitted by law, Rento's total liability is limited to the amount you paid us in the preceding 12 months (if any).

Severability and Waiver

If any provision is held invalid or unenforceable, it will be severed, and the remainder will remain in full force. No waiver of any breach constitutes a waiver of subsequent breaches.

Applicable Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved exclusively through arbitration in Cape Town under the rules of the Arbitration Foundation of Southern Africa (AFSA), conducted in English. The unsuccessful party bears all costs. You agree not to pursue class actions or consolidated claims.

Email Disclaimer

Emails from Rento may contain confidential/privileged information. If received in error, delete and notify us immediately—do not use or distribute. Emails represent opinions (not guaranteed facts) and are sent when logged by our provider; receipt occurs upon acknowledgment. While we take precautions, we disclaim liability for viruses or reliance unless expressly warranted and signed.

Specific Service Terms

Property Listing Service

• Rento is not a real estate professional and does not negotiate/conclude deals.
• You verify all parties/credentials independently and use the service at your own risk.
• Submitted materials must comply with laws (e.g., no unlawful/harmful content); Rento may moderate/remove at discretion.
• You grant Rento the license described above.
• Listings must be in English.
• Fees (if any) are non-refundable; non-payment may suspend access.
• Any OTP (Offer to Purchase) tools are templates only—Rento is not liable for them or related attorney services.

Tenant Screening Service

• Involves processing personal data (e.g., ID, credit, background) by Rento and partners, compliant with POPIA.
• By requesting/completing screening, you consent to collection, processing, and sharing as needed.
• Reports are for informational use only; Rento makes no guarantees of accuracy/completeness.

Rento Offers

• By using, you consent to sharing data with third-party providers for requested services (e.g., cash offers). Providers must comply with applicable laws.

Responsible Advertising Code

Rento promotes ethical practices and may remove content involving hate speech, discrimination, misinformation, or violations of fairness/respect.
